Terms and Conditions

Please read these terms and conditions carefully before using Our Service.

Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

"Directorate"

means the Human Rights Directorate, falling within the purview of the Office of the Prime Minister – Equality, Reforms and Social Dialogue (Government of Malta), and situated at A​3 Towers, Triq l-Arkata,​ Paola, PLA 1211, and the terms "We", "Us" and "Our" shall be read and construed accordingly;

"Personal Data"

means information relating to an identified or identifiable natural person;

"Profile"

means a User's summary of their personal details created by You to access our Service or parts of our Service;

"Service"

means the I Belong Programme and the I Belong Registration and Profile Portal, including user Profile management, enrolment administration, document verification, status tracking, communications, and all digital functionalities supporting the Programme;

"User"

means an individual accessing or using the Service who is eligible for the I Belong Programme, and the terms "You" and "Your" shall be read and construed accordingly;

"Website"

means the registration form and Profile.

Acceptance of Terms

By creating a Profile or accessing the Service, you agree to be bound by these Terms.

If you do not agree to any part of these Terms, You must not access or use the Service.

Eligibility

By accepting and acknowledging these terms and conditions, You are hereby confirming that You are over 18 years of age.

Purpose and Scope of the Service

The Service enables Users to:

  1. register for the I Belong Programme;
  2. create and update a Profile;
  3. upload documents required for verification;
  4. receive I Belong Programme communications;
  5. view registration and participation status.

The Service supports national integration efforts and may evolve over time to improve access and delivery.

Accessing the Website

Access to the Website is permitted on a temporary basis, and We reserve the right to withdraw or amend the information and/or services, including amending a user's course status and the integration support We provide on the Website without notice (see below).

We will use reasonable endeavours to ensure that the site is available 24 hours a day, 7 days a week. We shall not, however, be liable if for any reason the website is unavailable at any time or for any period.

If You choose, or You are provided with, a user identification code, password, or any other piece of information as part of our security procedures, You must treat such information as confidential, and You must not disclose it to any third party. The Directorate reserves the right to disable any user identification code or password, whether chosen by You or allocated by Us, at any time, if in Our opinion You have failed to comply with any of the provisions of these terms and conditions of use.

When using the Website, you must refrain from making or doing anything listed under the "Prohibited Uses" section of these terms and conditions. You are responsible for making all arrangements necessary for you to have access to the Website. This should also be applicable in cases when a person is applying on behalf of someone else.

User Profile

When You create a profile with Us, You must provide Us information that is true, accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your profile on Our Service.

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

You shall not disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your profile.

You may not use as a username, the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You, without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Content Restrictions

The Directorate is not responsible for the content on the User's profile. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your profile, whether done so by You or any third person using Your profile.

You may not transmit any content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable content include, but are not limited to, the following:

  • Unlawful or promoting unlawful activity;
  • Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups;
  • Spam, machine-generated or randomly-generated content, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling;
  • Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person;
  • Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights;
  • Impersonating any person or entity including the Directorate and its employees or representatives;
  • Violating the privacy of any third person;
  • False information and features.

The Directorate reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any content is appropriate and complies with this Terms, refuse or remove this content. The Directorate further reserves the right to make formatting and edits as it deems necessary and in adherence to the Terms and Conditions and change the manner of any content. The Directorate can also limit or revoke the use of the Service if You post such objectionable content. You agree that under no circumstances will the Directorate be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.

Content Backups

The Directorate shall endeavour to minimise as much as possible loss or corruption of data through regular backups of content.

Corrupt or invalid backup points may be caused by, without limitation, content that is corrupted prior to being backed up or that changes during the time a backup is performed.

The Directorate will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of content.

You agree to maintain a complete and accurate copy of any content in a location independent of the Service.

Intellectual Property Infringement

Our content, logos, domain names, patents, copyrights and other related intellectual property rights, and all other features related to their ownership and use, belong to the Directorate. Your use of our services does not grant You any rights in Our and/or our licensors' intellectual property, whether for commercial or non-commercial use. If You wish to use Our content other than as permitted by these Terms of Service, then you need a licence to do so.

We respect the intellectual property rights of others. It is Our policy to respond to any claim that content posted on the Service infringes a copyright or other intellectual property infringement of any person.

If You are a copyright owner, or authorized on behalf of one, and You believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Service, You must submit Your notice in writing to the attention of our copyright agent via email at [email protected]. Your notice must include a detailed description of the alleged infringement.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any content is infringing Your copyright.

All the above stipulations are regulated and in adherence to Chapter 415 of the Laws of Malta, as well as EU Legislation.

Termination

We may terminate or suspend Your profile immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your profile, You may simply discontinue using the Service.

Governing Law

The terms of this agreement shall be governed by the laws of Malta, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws, depending on your territory, domicile and location.

Translation Interpretation

These Terms and Conditions may have been translated. If we have made them available to you on Our service, you agree that the original English text shall prevail in the case of a discrepancy.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Personal Data and Privacy (GDPR)

The Permanent Secretary of the Office of the Prime Minister – Equality, Reforms and Social Dialogue acts as the Data Controller for Personal Data processed through the Service.
